Section 1 - If the applicable law so permits, property in and title to Products shall remain with X-Cal Corporation (X-Cal), and shall not pass to Customer, until X-Cal has received payment of the full price and license fees (if applicable) for (a) all Products, Software and/or Services that are the subject of these Terms, and (b) all other goods and/or services supplied by X-Cal to Customer under any contract whatsoever. Payment of the full price and license fees shall include without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between X-Cal and Customer. Moreover, the Customer shall keep the Products identified as retained until such retention lapses.
Section 2 - If the applicable law does not permit the arrangement described in Section 1 above, X-Cal hereby reserves in the Products (as well as all proceeds resulting from any sale thereof), and Customer grants and agrees that the Products shall remain fully subject to, a first priority purchase money security interest, until X-Cal has received payment of the full price and license fees (if applicable) for all the products ordered. Payment of the full price and license fees shall include without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between X-Cal and Customer. Moreover, Customer hereby covenants that (i) no hindrance to its granting of the above security interest exists in any of its third-party contracts; or (ii) in the event such a hindrance does exist, Customer shall assist X-Cal in exercising, and shall take all actions necessary to protect and maintain, such security interest.
Installation Quotes and Scheduling
120-Day Installation Quotes - By default, all line-item quotes for installation will expire within 120 days from the receipt of equipment. This deadline ensures clarity and creates a sense of urgency. As a sales representative, you may extend this expiration date to accommodate a customer’s unique needs. Please ensure the 120-day expiration is consistently applied to all future installations.
30-Day Installation Scheduling - All installation quotes should advise customers to allow for up to 30 days to schedule installation services. If necessary, this timeframe can be extended based on a customer’s unique requirements. The goal is to establish realistic expectations upfront and prevent instances where customers expect installation within just a few days. Communication with customers should emphasize this standard timeframe to streamline scheduling and avoid any miscommunication.
Installation Scheduling Point of Contact (POC) - For all installation scheduling, please coordinate exclusively through Mark Venske. Mark serves as the single point of contact for installation logistics. To maintain smooth operations, please avoid contacting technical team members directly by phone, text, or email for scheduling purposes. Ensuring all communication goes through Mark will help maintain efficiency and reduce any confusion regarding scheduling details.
Return Policy
A 50% cancellation fee will apply on any order canceled after delivery. A 40% cancellation fee will apply to any orders canceled prior to delivery.
X-Cal must be notified within five working days of the customer's intent to return the product. Returning an item after it has been received by the purchaser must be completed within 5 working days of receipt and will result in a 30% restocking fee which will be calculated on the gross amount of the Purchase Order and any shipping/freight costs will be billed to the purchaser. This assumes the product is in ORIGINAL, UNOPENED (new) condition and the product will not be returned until all fees and shipping/freight charges are paid in full. An inspection prior to acceptance of return may be required to certify the condition of the product. This cost shall be paid by the purchaser.
X-Cal is not responsible for any damages to items being returned.
Privacy Policy
X-Cal gathers information about all users collectively, such as what areas users visit most frequently and what services users access most often. X-Cal automatically logs IP addresses, session information, and other data which tracks users’ access to the Services. The personal information you supply to X-Cal will not be given, sold, rented, loaned, or otherwise disclosed to any third parties outside of X-Cal and its agents, except when we have your permission or under special circumstances, such as when we believe in good faith that disclosure is reasonably necessary to 1) comply with legal process, 2) enforce the Terms of Use, 3) respond to claims that any content provided by using the Services violates the rights of third parties, or 4) protect the rights, property, or personal safety of Amatrol, its users, or the public.
All of your personal information is stored on servers at a location designed specifically to ensure that no unauthorized individuals have access to the server or its data.
